§ 18-73. Alternative standards.

  • (a)

    Property owners required to comply with the provisions of this division may establish alternative standards if more than one-half of the property owners in such flood district have agreed in writing to undertake specific alternative flood control measures, which writing is filed with the city council at the time the flood district plan is established.

    (b)

    In such case, the property owner whose property is subject to this division will be required to conform, as a minimum, to the standards set forth in the alternative plan proposed and accepted by the majority of property owners in that area.

    (c)

    In the event a majority of property owners in such flood district undertake and agree to an alternative plan, and a property owner within such flood district fails to comply with the requirements of section 18-76 or the alternative plan, whichever imposes the less restrictive standard, the city may, if it so elects, construct the flood control measures following the procedures hereinafter set forth, in which case it shall utilize the standards set forth in section 18-76.
