§ 18-74. Adoption of general standards and requirements for construction or development within "A-zones" as designated on the city's FIRM or the city's FHBM.

  • In compliance with Rule 44 CFR 60.3, as recently promulgated by the Federal Emergency Management Agency (FEMA) and with respect to the city FIRM and FHBM (as incorporated by reference thereto under section 18-24(b)), all development or construction in the "A-zones" designated on the city's map shall meet the following standards and regulations:

    (1)

    Special construction permits required . A special permit shall be required for all construction or development that may hereafter be proposed, including the placement of manufactured homes, where the sites thereof would be located within an "A-zone" as designated on the city's FIRM or FHBM. Such permit application shall be filed with, reviewed by and either granted or denied by the director of public works, as provided in section 18-47(a).

    (2)

    Precondition for approval . The director of public works shall:

    a.

    Review the proposed development to assure that all necessary permits have been received from those governmental agencies from which approval is required by federal or state law, including section 404 of the Federal Water Pollution Control Act Amendments of 1972, 33 USC 1334 (Federal Rule reference: 44 CFR 60.3(a)(2));

    b.

    Review all permit applications to determine whether proposed building sites will be reasonably safe from flooding. If a proposed building site is in a floodprone area, all new construction and substantial improvements shall:

    1.

    Be designed (or modified) and adequately anchored to prevent flotation, collapse or lateral movement of the structure resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy;

    2.

    Be constructed with materials resistant to flood damage;

    3.

    Be constructed by methods and practices that minimize flood damage; and

    4.

    Be constructed with electrical, heating, ventilation, plumbing, and air conditioning equipment and other service facilities that are designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding (Federal Rule reference: 44 CFR 60.3(a)(3)).

    c.

    Review subdivision proposals and other proposed new developments, including manufactured home parks or subdivisions, to determine whether such proposals will be reasonably safe from flooding. If a subdivision proposal or other proposed new development is in a floodprone area, any such proposals shall be reviewed to assure that all such proposals are consistent with the need to minimize flood damage within the floodprone area, and that all public utilities and facilities, such as sewer, gas, electrical and water systems, are located and constructed to minimize or eliminate flood damage, and that adequate drainage is provided to reduce exposure to flood hazards (Federal Rule reference: 44 CFR 60.3(a)(4)).

    (3)

    Additional requirements for approval . It shall be a requirement for approval of any such construction or development within a floodprone area that:

    a.

    New and replacement water supply systems be designed to minimize or eliminate infiltration of floodwaters into the systems; and

    b.

    New and replacement sanitary sewage systems be designed to minimize or eliminate infiltration of floodwaters into the systems and discharges from the systems into floodwaters and on-site waste disposal systems be located to avoid impairment to them or contamination from them during flooding (Federal Rule reference: 44 CFR 60.3(a)(5), (6)).

    (4)

    Base flood elevation data to be provided for certain development proposals .

    a.

    It shall be a requirement that all new subdivision proposals and other proposed developments (including proposals for manufactured home parks, mobile home parks and subdivisions) greater than 50 lots or five acres, whichever is the lesser, specifically address and include within such proposals certain base flood elevation data.

    b.

    The proponent of such development or new subdivision shall, in order to implement the permit application process, obtain and utilize in its proposal and the director of public works or his deputy shall insist upon the inclusion of such flood elevation data as will facilitate the duties of the director of public works in the performance of those duties to monitor and exercise supervision which are imposed upon such officer by section 18-48 (Federal Rule reference: 44 CFR 60.3(b)(3)).

    c.

    It shall be required that all manufactured homes to be placed within zone A on the city's FHBM or FIRM shall be installed using methods and practices which minimize flood damage. For the purposes of this requirement, manufactured homes must be elevated and anchored to resist flotation, collapse or lateral movement. Methods of anchoring may include, but are not to be limited to, use of over-the-top or frame ties to ground anchors. This requirement is in addition to applicable state and local anchoring requirements for resisting wind forces (Federal Rule reference: 44 CFR 60.3(b)(8)).
