§ 40-92. Enforcement of article; continuous maintenance required; penalty for violation.

  • (a)

    Enforcement of the provisions of this article shall be the responsibility of the city administration, who shall delegate the continuous monitoring of the condition and maintenance of greenbelts and landscaping provided by this article to personnel of the building department or department of public works as he may deem appropriate. A citation for a violation of this article may be issued by such deputy only upon the written approval and endorsement of the city administrator.

    (b)

    No owner or lessee or occupant of property shall fail to continuously maintain, to the standard of this article, landscaping and screening (greenbelt) materials shown on a site plan or building permit application.

    (c)

    No building permit shall be issued for property which is in violation of this article.

    (d)

    No certificate of occupancy nor renewal certificate shall be issued in the future unless the provisions of this article have been and are being met or a performance bond or other security has been posted to ensure compliance or recompliance.

    (e)

    Violation of any provision of this article constitutes a civil infraction punishable by a civil penalty of not more than $500.00.
