§ 6-181. Revisions, amendments, additions, insertions and preservations.

The 2015 Edition of the International Property Maintenance Code is amended and revised as follows:

IPMC § 101.1. Title. Insert: "City of Gibraltar" for "[NAME of JURISDICTION]."

IPMC § 102.3. Application of other codes. Revise to read as follows: "Repairs, additions or alterations to a structure, or changes of occupancy shall be done in accordance with the procedures and provisions of the Michigan Building Code, Michigan Residential Code, Michigan Plumbing Code, Michigan Mechanical Code, National Electrical Code, International Fire Code, Chapter 44 Zoning, Code of Ordinances, City of Gibraltar, Michigan, and the Fuel and Gas Code. Nothing in this case shall be construed to cancel, modify, or set aside any provision of Chapter 44 Zoning, Code of Ordinances, City of Gibraltar, Michigan."

IPMC § 103.5 Fees. Insert: "The fees for activities and services performed by the department in carrying out its responsibilities under this code shall be as indicated in the schedule of fees as adopted by the City Council." for "[APPROPRIATE SCHEDULE]."

IPMC § 106.3 Prosecution of a Violation. Revise to read as follows: "Any person failing to comply with a notice of violation or order served in accordance with Section 107 shall be deemed guilty of a misdemeanor as provided for in Section 1-7 General penalties and sanctions for violations of code and City ordinances; continuing violations and injunctive relief, and the violation shall be deemed a strict liability offense. If the notice of violation is not complied with, the code official shall institute the appropriate proceeding at law or in equity to restrain, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the structure in violation of the provisions of this code or of the order or direction made pursuant thereto. Any action taken by the authority having such jurisdiction on such premises shall be charged against the real estate upon which the structure is located and shall be a lien upon such real estate."

IPMC § 107.5 Penalties. Revise to read as follows "Penalties for noncompliance with orders and notices shall be set forth in Section 106.3 and 106.4."

IPMC § 112.4 Failure to Comply. Insert: "$150.00" for the first reference to "[AMOUNT]" and not less than "$300.00" for the second reference to "[AMOUNT]".

IPMC § 201.3 Revise to read as follows: "Where terms are not defined in this code, and are defined in the Michigan Building Code, Michigan Residential Code, Michigan Plumbing Code, Michigan Mechanical Code, National Electrical Code, International Fire Code, Chapter 44 Zoning, Code of Ordinances, City of Gibraltar, Michigan, and Fuel and Gas Code, such terms shall have the meanings ascribed to them as in those codes. Nothing in this case shall be construed to cancel, modify or set aside any provision of Chapter 44 Zoning, Code of Ordinances, City of Gibraltar, Michigan."

IPMC § 302.4 Weeds. Revise to read as follows: "§§ Sections 40-61 through and including 40-66, Article III. Noxious Weeds, Chapter 40 Vegetation, Code of Ordinances, City of Gibraltar, Michigan are hereby preserved and shall remain the governing provisions with respect to weeds in said City."

IPMC § 304.14 Insect Screens. Insert: "May 1" for the first reference to "[DATE]" and "October 31" for the second reference to "[DATE]".

IPMC § 602.3 Heat Supply. Insert: "September 1" for the first reference to "[DATE]" and "April 30" for the second reference to "[DATE]".

IPMC § 602.4 Occupiable Work Spaces. Insert: "September 1" for the first reference to "[DATE]" and "April 30" for the second reference to "[DATE]".
