§ 22-495. Curfew for minors.

  • (a)

    Definitions . The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Public place means any street, highway, alley, park, public building or place of business or assembly open to or frequented by the public, or any other place which is open to the public view or to which the public has access.

    (b)

    Loitering prohibited; restrictions and hours. A minor under 12 years of age shall not loiter, idle, congregate, or otherwise be in a public place between the hours of 9:00 p.m. and 6:00 a.m.; a minor under 15 years of age shall not loiter, idle, congregate, or otherwise be in a public place between the hours of 10:00 p.m. and 6:00 a.m.; a minor under 17 years of age shall not loiter, idle, congregate, or otherwise be in a public place between the hours of 11:00 p.m. and 6:00 a.m., unless the minor is accompanied by a parent or guardian or some adult above 21 years of age delegated by the parent or guardian to accompany the minor, or where the presence of the minor in the public place is required by some legitimate work, trade, profession, occupation or other legitimate business directed by his parent or guardian.

    (c)

    Exemptions. The provisions of subsection (b) of this section do not apply to persons who:

    (1)

    Are or have been married, or have the disabilities of minority removed pursuant to statute;

    (2)

    Are accompanied by a parent or guardian;

    (3)

    Are engaged in employment or employment-related activities;

    (4)

    Are engaged in interstate travel;

    (5)

    Are attending school, religious or civic organizational activities that are supervised by persons 18 years of age or older;

    (6)

    Are exercising First Amendment rights or activities;

    (7)

    Are in public places because of an emergency;

    (8)

    Are on the sidewalk or premises in front of his home or an adjacent home; or

    (9)

    Are on an emergency errand for his parent.

    (d)

    Parental responsibility. A parent, guardian, or other person having the care or custody of any minor shall not permit, allow, or encourage such minor to violate the city curfew.
