§ 14-25. Construction noises.

  • (a)

    Intent. To protect the peace and quiet of the community that may be disturbed due to construction projects in and about the community, the city council has determined that all construction work, commercial or private, shall be restricted to the hours and under the terms that follow.

    (1)

    Restriction of hours of operation . Construction work, private or commercial, shall be restricted to the following hours:

    During
    Eastern Standard Time 8:00 a.m. to 6:00 p.m.
    Daylight Saving Time 7:30 a.m. to 9:00 p.m.
    Weekends 8:30 a.m. to 7:30 p.m.

     

    (2)

    Definitions. The following words, terms and phrases, when used in this section shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Construction work means the use of hammers, motorized equipment, construction vehicles, or any other type of equipment that emits sound audible from 15 feet.

    (3)

    Exceptions. Nothing in this section shall prevent a public entity from performing work during the restricted hours of operation. Further, private residents or commercial contractors may, if an emergency arises where the work is necessary for the preservation of life or property, perform construction work during the hours of restriction providing the nature of the work and the reason for said work is reported to the police department prior to commencing such work.

    (4)

    Notice of restrictions with permits. The building department shall give commercial contractors and/or private citizens notice of the restrictions with building permits. Failure to give notice, however, shall not invalidate this section.

    (b)

    Penalty. Violations of this section shall constitute a nuisance, and violators will be deemed to have committed a civil infraction, punishable by a fine up to $500.00.
