§ 14-19. Offense; penalties.
(a)
Civil infraction. An offense under this article shall be deemed to be a civil infraction only if immediate compliance is achieved in response to a lawful command of any peace officer and such sound level is promptly adjusted by the violator. The maximum fine shall be as provided in section 1-7 for such civil infraction unless stated otherwise.
(b)
Misdemeanors. An offense under this article shall be deemed to be a misdemeanor if, in response to a lawful command of a peace officer, the person in control of such electronically amplified sound device knowingly continues, declines or refuses to reduce the volume of sound being emitted therefrom.
