§ 8-131. Unlawful acts, conduct or events.

  • It shall be a violation of this division for any proprietor, owner, lessee or employee or any owner, lessee or proprietor of an adult bookstore, adult movie theatre, adult studio or mini-theatre located or hereafter to be located within the city limits to knowingly permit any of the following acts, conduct or events to occur upon the premises so operated or controlled by him:

    (1)

    It shall be unlawful to permit or be engaged in any illegal act or occupation on or beyond the licensed premises.

    (2)

    It shall be unlawful to permit any disorderly conduct or the use of any lewd conduct or obscene language, or to permit such place to become a resort for thieves, prostitutes or other disorderly persons.

    (3)

    It shall be unlawful to suffer or allow in or upon the licensed premises the annoyance, molestation, or accosting and soliciting for immoral purposes of any patron or employee by any other patron or employee.

    (4)

    It shall be unlawful to promote, display, advertise, deliver or exhibit for either sale, rental or viewing by members of the public any obscene or pornographic pictures, photographs, illustrations, mockups or models, films, slides or animation devices, displays, exhibits, motion picture films, videocassettes, cable television, or any other visual media exhibit, film clip or slides to public patrons or customers, and for the purposes of enforcement of this section, such picture, photograph, film, mockup or model or illustration shall be deemed to be obscene and pornographic if the same depicts, portrays or demonstrates any of the following:

    a.

    The performance of acts, or simulated acts, of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any sexual acts prohibited by law.

    b.

    The actual or simulated caressing or fondling of the breast, mammary glands, buttocks, pubic region or genitals.

    c.

    The actual or simulated displaying of the pubic hair, pubic region, anus, vulva or genitals, excepting, however, only those instructional materials exhibited in a medical, surgical or anatomical textbook used for medical or surgical instruction purposes that are hereby exempted from the provisions hereof.

    (5)

    It shall be unlawful to permit or allow gambling or the use, possession or presence of gambling apparatus or paraphernalia.
