§ 38-56. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Act means the Federal Clean Water Act (33 USC 1251 et seq.) as amended.

    Annual surveillance fee means those fees associated with the issuance of a wastewater discharge permit, which is based on the wastewater flow and components thereof.

    BOD (biochemical oxygen demand) means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20 degrees Centigrade expressed in terms of milligrams per liter as measured by standard methods.

    Debt service charge means charges levied to customers of the wastewater system that are used to pay principal, interests and administrative costs of retiring the debt incurred for construction of the wastewater system.

    Extra strength surcharge means those fees charged to individual users associated with the additional costs incurred at the treatment works for the treatment of wastewater with amounts of compatible pollutants exceeding normal domestic sewage.

    Nonresidential user surcharge means that flat rate charged to all nonresidential user classes (including industrial, commercial, institutional and governmental), based on metered water consumption associated with recovering the costs of the industrial pretreatment program and the surveillance, monitoring and enforcement activities as outlined in article V of the Wayne County Sewer Use Ordinance.

    Normal domestic sewage means wastewater which when analyzed shows a daily average concentration of not more than 275 milligrams per liter of biochemical oxygen demand (BOD), nor more than 360 milligrams per liter of total suspended solids (TSS), nor more than 12 milligrams per liter of phosphorous (P).

    Operations, maintenance and replacement (also OM & R) means those activities required to assure the dependable and economic functions of the facilities.

    (1)

    Operation. The control of the unit processes and equipment that make up the facilities. This includes, but is not limited to, the financial and personnel management, records, laboratory control, processing control, safety and emergency operation planning.

    (2)

    Maintenance. Preservation of functional integrity and efficiency of equipment and structures, including preventive maintenance, corrective maintenance and replacement of equipment as needed.

    (3)

    Replacement . Expenditures for obtaining and installing the equipment, accessories or appurtenances that are necessary for the useful life of the treatment works to maintain the capacity and performance for which such works were designed and constructed. The treatment operation and maintenance includes replacement.

    Phosphorus means the total concentration of all forms of organic and inorganic phosphorus compounds in wastewater, expressed in milligrams per liter as phosphorus, as measured by standard methods.

    Service charge means the sum of the applicable OM & R charges, surcharges, debt service charges and other applicable fees or charges.

    Suspended solids means solids that either float on the surface of or are suspended in water, wastewater or other liquids, and which are removable by laboratory filtering, expressed in terms of milligrams per liter as measured by standard methods.

    System means those facilities owned and operated by the Wayne County South Huron Valley Wastewater Control System and facilities tributary thereto.

    User charge means the charge levied on the users of a treatment works for the cost of operation and maintenance of sewage works pursuant to section 204(d) of PL 92-500 and includes the cost of replacement.

    User class means the kind of user connected to sanitary sewers including residential, industrial, commercial, institutional and governmental.

    Commercial user means an establishment listed in the office of Management and Budget's Standard Industrial Classification Manual (SICM) involved in a commercial enterprise, business or service which, based on a determination by the county, discharges primarily segregated domestic wastes from sanitary conveniences and which is not a residential user or an industrial user.

    Governmental user means any federal, state or local government user of the wastewater treatment works.

    Industrial user means a user of the treatment works which discharges wastewater from industrial, manufacturing, trade or business processes or from any structure with these characteristics, as distinct from their employees domestic wastes or wastes from sanitary conveniences.

    Institutional user means any establishment listed in the SICM involved in a social, charitable, religious or educational function which, based on the determination by the county, discharges primarily segregated domestic wastes or wastes from sanitary conveniences.

    Residential user means a user of the treatment works whose premises or buildings are used primarily as a domicile for one or more persons including dwelling units such as detached, semidetached and row houses, mobile homes, apartments or permanent multifamily dwellings (transit lodging is not included and is considered commercial).
