§ 32-142. Area requirements to comply with zoning chapter; exception; approval of planning commission.

  • (a)

    Lots, outlots or other parcels of land may be partitioned or divided into no more than four parts; provided, that the resulting parts meet the minimum requirements of chapter 44 as to width and area.

    (b)

    The width and area requirements of subsection (a) of this section shall not apply if both of the following conditions are satisfied:

    (1)

    The original lots, outlots or other parcels of land do not conform to the width and area minimum requirements of chapter 44; and

    (2)

    The smallest of the resulting parts has the same or a greater width and area in comparison with that of the smallest of the original lots, outlots or other parcels of lands.

    (c)

    The partitioning or dividing into three or four parts shall be approved by resolution of the planning commission.
