§ 22-372. Marijuana plants growing in open field; seizure.

  • (a)

    It is unlawful for any person knowingly or intentionally to permit marijuana plants to grow in any open field, owned by him or under his control. The term "open field" shall include any field, lot or other parcel of land not enclosed by a building or structure.

    (b)

    Any marijuana found growing in such open field shall be forthwith seized by the department of public safety and destroyed as provided by law, except such marijuana may be preserved by such department as long as may be necessary for its use as evidence in any court of competent jurisdiction.
