§ 22-370. Possession.

  • It is unlawful for any person knowingly or intentionally to possess a controlled substance unless the substance was obtained directly from, or pursuant to, a valid prescription or order of a practitioner while acting in the course of his professional practice, or except as otherwise authorized by Public Act No. 368 of 1978 (MCL 333.7101 et seq.), or any amendments thereto. Any person who violates this section with respect to:

    (1)

    Lysergic acid diethylamide, peyote, mescaline, dimethyltryptamine, psilocyn, psilocybin or a controlled substance classified in schedule 5, is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or by a fine of not more than $500.00 or both;

    (2)

    Marijuana, is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or by a fine of not more than $500.00 or both.
