§ 2.1. Continuation of powers of former Charter.

  • All powers, privileges and immunities not inconsistent with the provisions of this Charter possessed by the Village of Gibraltar by virtue of its incorporation as such, and enumerated in the Charter of the Village which is hereby superseded, are hereby expressly retained by the city and shall constitute a part of the powers of the city, even though not expressly enumerated herein.

Editor's note

Given the broad grant of powers to home rule cities, the provisions of Charter section 2.1 (which section provides that the city has the powers of a village) are obsolete and not needed. As the section limits the powers to those in effect prior to the Charter becoming effective (i.e., on August 15, 1961), the section is useless as it would be almost impossible to determine those powers.
